A concealed carry permit holder who fatally shot an armed attacker will not face criminal charges, says Montgomery County District Attorney Kevin R. Steele.
The shooting was on March 18, 2023, at a cemetery in Horsham Township, Pennsylvania. Our permit holder was at a birthday celebration for a friend who was killed in 2013.
According to the DA’s press release, Arian Davis, age 33, was sitting in a car at the cemetery with others when 29-year-old Daniel Hawkins approached and began shooting at them.
Concealed Carry Permit Comes In Handy
Davis had a valid concealed carry permit and legally owned a firearm. Hawkins shot him multiple times but Davis managed to retrieve his weapon and fire back at Hawkins, ultimately killing him.

According to Fox News, the investigation revealed that Hawkins had a firearm that had been illegally altered to become automatic. He also had previous felony convictions that prohibited him from possessing firearms. Furthermore, the vehicle Hawkins had driven to the location had recently been reported stolen by Philadelphia Police.

Fox News and NBC10 News indicate that Hawkins and Davis, knew each other previous to the attack. Reports say that both were from the area.
Upon investigating the scene, police told the press that there had been over 30 shots fired.
Permit Holder Acted In Self-Defense
After analyzing the evidence, the DA determined that the permit holder had acted in self-defense. He had feared for his life so his actions were justified.
“Davis was under attack and in danger of being killed when he fired his legally owned weapon to end the threat. For these reasons, I conclude that this was a justifiable shooting, and therefore, no criminal charges are warranted,” Steele said in the press release.
