The Michigan State Senate this week continued its efforts to infringe on citizens’ 2A rights. On Wednesday, Senate Democrats passed another constitutionally dubious firearm regulation bill, a so-called “red flag” law.

The legislation passed along party lines with a vote of 20-17. This is the third major gun reform package state Democrats have pushed through in the wake of the MSU shooting. The previous two, focused on “universal” background checks and “safe storage” of firearms, were signed by Gov. Whitmer last week.

Moreover, this legislation is the first of a four-bill package to institute firearm confiscation laws.  The other three bills are expected to hit the Senate Floor today. They extend “red flag” infringements by removing a person’s right to buy a firearm if they are under such orders (HB4146), remove fees from “red flag” petitions (HB 4147), and impose penalties against individuals who violate a “red flag” order (HB 4148).

Under the proposed “red flag” bill, courts have the ability to issue protection orders that involve the confiscation of firearms against individuals they deem to be a risk to themselves or others.

Additionally, a spouse, neighbor, family member, or even an ex-spouse or boyfriend/girlfriend can instigate the court review. After the order, an individual has 24 hours to surrender their firearms. After which, law enforcement will seize them.

Only after an order is issued will the person be able to request a hearing for the court to reconsider their decision and reinstitute their rights.

    Sen. Mallory McMorrow sponsored the bill. She claims that the bill will save lives.

    In a previous statement to The Detroit News, McMorrow claimed, “These laws will help prevent tragedies before they occur while maintaining due process, by allowing law enforcement to temporarily remove firearms from individuals who pose a risk to themselves or others.”

    Opposition to “Red Flag” Gun Control

    Opponents of the bill claim otherwise. Presque Isle Sheriff Joe Brewbaker, one of the officials that may be forced to carry out the unconstitutional confiscation, stated Monday, “These laws trample all over the constitutional rights of the people that I’ve sworn to protect.”

    Tom Lambert, the legislative director of Michigan Open Carry, stated, “Everybody agrees that at some point, somebody can be a danger to themselves. The issue is at what point do we consider a danger to themselves.”

    Further, Lambert claims that Michigan’s version of a red flag law is too broad. He wants the bar to be set high before a judge grants the order.

    “The higher the threshold, the more due process there is and the more constitutional it is,” Lambert told WILX News.

    The Next Step for Michigan Gun Confiscation Laws

    Michigan will join 19 other states to institute ‘red flag’ laws.

    This bill is the main proposal of the three-bill package. Having passed the Senate, the legislation is expected to hit Gov. Whitmer’s desk soon, followed by the others as they are approved.

    Additionally, Gov. Whitmer told The Detroit News she is looking forward to singing the “red flag” bills.

    After being signed, the new laws will go into effect early next year.
